These Terms of Service (“Terms”) govern your use of sparklift.app and all SparkLift services, including accounts, Sparks (creator communities), forums, direct messages, memberships, digital products, custom requests, merchandise, payments and uploaded content.
By creating an account or using SparkLift, you agree to these Terms. If you do not agree, please do not use SparkLift.
If you sell on SparkLift as a creator, the Creator Agreement also applies to you. If the Creator Agreement and these Terms conflict on a selling or payout matter, the Creator Agreement wins.
SparkLift is operated by SPARKLIFT LTD (“SparkLift”, “we”, “us”), a private limited company registered in England and Wales.
SparkLift is a platform where creators run their own communities, called Sparks, and fans can join, talk and support them. Depending on the creator, SparkLift may offer:
Some features may be in testing, limited to approved creators, or changed or withdrawn over time.
You must be at least 13 years old to use SparkLift. If you are under 18, you may only use SparkLift with the permission of a parent or legal guardian, and you may not make purchases without their consent.
Creator accounts, selling and payouts are only available to people aged 18 or over who can enter into a binding contract.
You agree to give accurate information, keep your password secure, not share your account, tell us promptly about any unauthorised access, and take responsibility for activity under your account.
We may suspend, restrict or close an account that breaks these Terms, is fraudulent, creates risk for others, or where we need to do so to protect SparkLift, our users or third parties.
Anyone can create a free account. Selling, memberships and payouts require a creator account, which we review and approve manually. Applying does not guarantee approval, sales, audience growth or income. Approved creators must accept the Creator Agreement.
SparkLift is a family-friendly community. You must not post, upload, sell, promote or link to anything that is:
We may remove content, limit its visibility, issue warnings, suspend or ban accounts, and report serious matters to the authorities.
Direct messages are visible only to the people in the conversation. They are not end-to-end encrypted. We do not read messages routinely, but we may review a conversation when it is reported to us, when we need to investigate abuse, fraud or a safety concern, or when the law requires it.
You keep ownership of what you post. By posting or uploading content, you give SparkLift a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, format, distribute and use it as needed to operate, promote and improve SparkLift. This licence ends when you delete the content, except for copies kept in backups for a limited time, content others have already shared or quoted, and anything we must keep for legal reasons.
You confirm that you have the rights to everything you upload and that it does not break any law, anyone else’s rights, or these Terms.
Payments are processed by Stripe. Prices are shown in US dollars. By buying, you also agree to Stripe’s terms for payment processing.
Most items on SparkLift are offered by independent creators. SparkLift runs the platform, takes payment, provides support and, for merchandise, arranges production and delivery. Creators are responsible for what they describe and deliver, and we will help resolve problems between you and a creator.
A membership gives you access to a creator’s members-only content for as long as it stays active. Membership prices, billing periods and what is included are shown before you pay.
Memberships renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account. When you cancel, you keep access until the end of the period you have already paid for, and we will not charge you again.
Access ends if a payment fails and is not resolved, if the membership is cancelled or expires, or if your account is suspended for breaking these Terms.
On paid posts, the written text may be visible to everyone, while photos, videos, embedded media and links are reserved for members.
You must not copy, redistribute, resell, scrape, share private links to, or otherwise make members-only content available to people who have not paid for it, and you must not try to get around access controls.
Digital products are delivered immediately after purchase. Custom requests are made specifically for you by the creator after you order.
If a creator cannot take on a custom request, you receive a full refund.
Merchandise is printed to order by our fulfilment partner, Printful, after you buy. Delivery is charged at checkout at the real carrier rate for your order and address, and shown before you pay.
Orders are normally sent into production within a few days of purchase, and printing then takes further business days before the carrier collects it. Delivery times shown are estimates, not guarantees. We are not responsible for delays caused by carriers, customs, an incorrect address you provided, or events outside our reasonable control. Import duties or taxes charged by your country are your responsibility unless shown otherwise at checkout.
Our Refund and Returns Policy explains when you can get a refund or replacement. In summary: faulty, damaged or wrong merchandise reported within 30 days of delivery is replaced or refunded; memberships can be cancelled at any time for future periods; and digital products and custom requests are not automatically refundable, but we will put it right if what you received is faulty, not as described, or never arrived.
Nothing in these Terms or that policy removes rights you have under consumer law.
Prices may include or exclude sales tax or VAT depending on where you are. Any tax due is calculated and shown at checkout.
How creators earn, how commissions work, and how payouts, refunds and chargebacks affect creator balances is set out in the Creator Agreement.
Physical product losses. If a physical order cannot be fulfilled, or a defect or damage claim is not covered by our fulfilment partner, the resulting loss is shared between SparkLift and the creator rather than falling entirely on one side. SparkLift’s share of any such loss is capped at the profit SparkLift actually earned on that sale, so SparkLift will never be left with a negative amount on a single order because of this. Any loss beyond SparkLift’s share is the creator’s responsibility, since it relates to their own product listing or claim.
Worked example. A $26.99 t-shirt earns SparkLift $5.40 on that sale. If the shirt’s $13.50 production cost is later confirmed as an unrecoverable loss (for example, a fulfilment claim is declined), SparkLift’s share of that loss is capped at the $5.40 it earned: SparkLift’s net result on that order is $0, never negative, and the creator is responsible for the remaining $8.10. A loss smaller than SparkLift’s profit on that sale is covered by SparkLift in full, and the creator owes nothing.
SparkLift’s name, logos, mascot, design, software and platform materials belong to SparkLift or its licensors. You may not copy, modify, reverse engineer, resell or use them without our written permission.
If you believe something on SparkLift infringes your copyright, please follow our Copyright and DMCA Policy at sparklift.app/dmca.
SparkLift relies on third-party services, including Stripe (payments and tax calculation), Printful (merchandise production and delivery), Amazon Web Services (hosting, media storage and email), Cloudflare (security and performance) and Google (spam protection). They have their own terms and privacy policies. We are not responsible for their services except where the law says otherwise.
You must not:
You can report a post, message, account or product using the report option on it, or by emailing [email protected] with links and details. We review reports and decide what action to take. For privacy and safety reasons, we may not always tell you what action was taken.
We aim to keep SparkLift available but cannot guarantee it will always be uninterrupted or error-free. We may carry out maintenance, change features, or suspend parts of the service when needed.
We may update these Terms. If a change is significant, we will tell you by email or a notice on the site before it takes effect. If you keep using SparkLift after the change takes effect, the updated Terms apply.
SparkLift is provided “as is” and “as available”. We do not promise that creators will earn money, grow an audience or reach any particular result, and we do not guarantee that content posted by users or creators is accurate, safe or suitable.
Nothing in these Terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or your rights as a consumer.
Subject to that, we are not liable for indirect or consequential losses, or for loss of profit, revenue, data or goodwill. Where our liability can be limited, our total liability to you is limited to the greater of the amount you paid SparkLift in the 12 months before the claim, or £100.
You can stop using SparkLift at any time and ask us to close your account by emailing [email protected]. We may suspend or end your access if you break these Terms, create risk for others, fail to pay, or if we stop providing the service.
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you keep any protections given by the mandatory laws of your country, and you may be able to bring a claim in your local courts.
